Terms of Use – Avamboo Encrypt for Outlook (New)
§ 1 Scope
These Terms of Use apply to the use of the Microsoft Outlook add-in "Avamboo Encrypt for Outlook (New)" (hereinafter "Add-in"), developed and operated by: Avamboo GmbH; Christian Braumüller Bahnhofsallee 13a 86438 Kissing Phone: 0821 57086670 info@avamboo.de By using the Add-in, the user agrees to these Terms of Use.
§ 2 Description of Services
The Add-in enables the encryption of emails and attachments directly from Microsoft Outlook (New Outlook for Windows and Outlook on the web). The main features include: • Full encryption of emails as a password-protected PDF (Free and Pro) • Encryption of individual PDF attachments (Pro only) • Password manager for secure management of recipient passwords (Free and Pro) • Team-wide password sharing (Pro only) The exact scope of features per plan is set out in the current pricing overview at www.avamboo-encrypt.com.
§ 3 Registration and User Account
Use of the Add-in requires a Microsoft 365 account and authentication via Microsoft Identity (Azure Active Directory). A separate registration with Avamboo is not required. The user is responsible for the security of their Microsoft account as well as their personal user key (password manager). Avamboo has no technical access to the user key.
§ 4 Plans and Payment
(1) Free plan The Add-in is available in a free basic plan (Free). The Free plan is limited to 2 encrypted emails per day and 30 per month. Free use may be discontinued without giving reasons. (2) Pro plan The Pro plan is offered for a fee. The current price can be found in the pricing overview at www.avamboo-encrypt.com. (3) Payment All prices are exclusive of statutory VAT. (4) Invoicing Billing takes place in advance.
§ 5 Term and Termination
(1) The Pro plan is concluded for a period of 12 months. (2) The user may terminate the Pro plan at any time. After termination, the Pro plan remains active until the end of the billing period already paid for. No pro-rata refund of fees will be made. (3) Once the Pro plan expires, the user is automatically downgraded to the Free plan. Pro features (e.g. encrypting PDF attachments, team sharing) will no longer be available. Data already stored in the password manager will be retained and remain accessible under the Free plan. (4) Avamboo reserves the right to suspend access without prior notice in the event of serious breaches of these Terms of Use.
§ 6 User Obligations
The user undertakes: • to use the Add-in exclusively for lawful purposes; • not to send any unlawful, offensive or harmful content; • to keep their personal user key secure and not to pass it on to third parties; • not to pass the license key on to unauthorized third parties.
§ 7 Availability and Maintenance
(1) Avamboo aims for the highest possible availability of the service but cannot guarantee uninterrupted availability. (2) Scheduled maintenance is, where possible, carried out outside normal business hours. (3) Avamboo is not liable for damages caused by temporary unavailability of the service, unless such damages are due to gross negligence or intent.
§ 8 Limitation of Liability
(1) Avamboo is liable without limitation for damages resulting from injury to life, body or health, as well as for damages caused intentionally or by gross negligence. (2) Otherwise, Avamboo's liability is limited to typical, foreseeable contractual damages. (3) Avamboo accepts no liability for the loss of the user key. Since Avamboo has no technical access to the user key, recovery by Avamboo is not possible. (4) Avamboo accepts no liability for damages resulting from improper use of the Add-in or from security vulnerabilities on the user's side.
§ 9 Intellectual Property
The Add-in and all associated content, graphics and software are the property of Avamboo GmbH and are protected by copyright. Reproduction, distribution or public performance without the express consent of Avamboo is prohibited.
§ 10 Changes to the Terms of Use
Avamboo reserves the right to amend these Terms of Use with reasonable prior notice (at least 30 days). The amended terms will be communicated to the user by email or through the Add-in. If the user does not object within the period, the new terms are deemed accepted.
§ 11 Applicable Law and Jurisdiction
The law of the Federal Republic of Germany applies. The place of jurisdiction, to the extent permitted by law, is Augsburg.
§ 12 Severability Clause
Should individual provisions of these Terms of Use be or become invalid, this shall not affect the validity of the remaining provisions.
